Supreme Court Refuses To Entertain Plea Challenging Freeze On Lok Sabha Seat Allocation Based On 1971 Census
New Delhi: The Supreme Court on Monday declined to entertain a petition challenging the constitutional validity of the freeze on the allocation of Lok Sabha seats based on the 1971 Census. The plea questioned the continued use of the decades-old population figures for determining parliamentary representation, arguing that the arrangement no longer reflects the country's present demographic realities.
The petitioner contended that significant changes in population over the last five decades have resulted in unequal representation among different states. It was argued that continuing the freeze on seat allocation violates the constitutional principle of equal representation and affects the democratic rights of citizens.
However, the Supreme Court refused to interfere with the existing constitutional and legal framework governing the allocation of Lok Sabha seats. The Bench declined to entertain the petition, effectively leaving the current position unchanged.
The freeze on the readjustment of parliamentary seats was introduced through constitutional amendments to encourage states to implement family planning measures without fear of losing parliamentary representation. As a result, Lok Sabha seats have continued to be allocated on the basis of the 1971 Census despite substantial demographic changes across the country.
The issue of delimitation has remained a subject of national debate, particularly between states that have successfully controlled population growth and those that have experienced significant population increases. Any future redistribution of parliamentary seats is expected to have important political and constitutional implications.
With the Supreme Court refusing to entertain the plea, the existing framework governing Lok Sabha seat allocation remains in force. The broader questions relating to delimitation and future seat redistribution are expected to be addressed through the constitutional and legislative process rather than judicial intervention.
